Acceptance of these terms

Welcome to HK Design. These Terms of Service (“Terms”) govern your access to and use of https://hkdesign.in, and your interactions with HK Design in relation to our services.

By accessing our website, submitting an enquiry, requesting a consultation or engaging our services, you agree to these Terms to the extent applicable to your interaction with us. If you do not agree, please do not use the website or proceed with a service engagement.

Specific projects may also be governed by a separate quotation, proposal, work order, agreement or other written confirmation. If a specific written agreement conflicts with these general Terms, the project-specific written agreement will prevail for that project to the extent of the conflict.

About HK Design

HK Design provides interior design and related services for residential, office and commercial spaces. The website is intended to introduce our work, explain our services and allow prospective clients to contact us.

References in these Terms to “HK Design”, “we”, “us” or “our” mean the HK Design business represented by Mr. Haroon Khan.

03

Our services

Depending on the requirements agreed for a particular project, our services may include:

  • Residential interior design and space planning.
  • Modular kitchen and bedroom design.
  • Living room and complete home interiors.
  • Office and commercial interior design.
  • Renovation and interior improvement work.
  • Design consultation, material selection and related project coordination.

The exact scope, deliverables, materials, execution responsibilities and services included in a project will be described in the relevant proposal, quotation or written confirmation. A service is not included merely because it is mentioned generally on our website.

04

Website use and enquiries

You agree to use our website lawfully and not to:

  • Submit false, misleading or impersonated information.
  • Attempt to gain unauthorised access to the website or its systems.
  • Introduce malicious code, disrupt website operation or interfere with other visitors.
  • Copy, misuse or reproduce website content in violation of applicable rights.
  • Use the website for unlawful, fraudulent or harmful purposes.

Submitting an enquiry does not automatically create a client relationship, confirm a booking, reserve a project slot or constitute acceptance of a quotation. Any engagement is subject to written confirmation by HK Design.

05

Proposals and quotations

Any estimate, proposal or quotation we provide is based on the information available at the time it is prepared. The final scope and price may depend on site conditions, measurements, material choices, specifications and the requirements confirmed by both parties.

  • Quotations are subject to the validity period, scope and conditions stated in the quotation itself.
  • Illustrations, renders, reference images and concepts are indicative unless expressly stated otherwise in writing.
  • Any work outside the agreed scope may require a revised quotation or additional approval.
  • A quotation is not a confirmed project booking until the required acceptance and payment conditions have been met and confirmed by HK Design.

Where a quotation contains specific terms that differ from these general Terms, the quotation will govern the relevant project matter.

06

Fees and payments

Service fees, taxes, payment milestones and accepted payment methods will be communicated in the relevant quotation, invoice or written project confirmation.

  • Clients must pay the agreed amounts according to the stated payment schedule.
  • Applicable taxes, including GST where chargeable, will be identified in the relevant invoice or quotation.
  • Additional work, upgrades, scope changes or client-requested variations may involve additional charges.
  • Where a payment is due before a stage of work can begin, that stage may be held until the payment is received and acknowledged.

Any advance, booking amount, instalment, cancellation adjustment or refund condition will be governed by the applicable project quotation or written agreement and applicable law. Do not assume that a payment is refundable or non-refundable unless the relevant terms state so.

07

Project commencement

A project will commence only after the required scope, commercial terms, client approvals and initial payment conditions have been agreed and confirmed.

Depending on the project, commencement may also require a site visit, measurements, access permissions, drawings, material selections or other information from the client. We will communicate the relevant requirements before the applicable work stage begins.

Any booking or consultation payment does not, by itself, mean that all project execution work has commenced. The services covered by such payment will be those specifically described in the applicable confirmation.

08

Client responsibilities

To help a project proceed effectively, clients are responsible for:

  • Providing accurate project details, measurements and relevant property information.
  • Providing lawful access to the site at mutually agreed times.
  • Obtaining permissions, approvals or consents that are the client's responsibility.
  • Reviewing designs, proposals, specifications and material selections within a reasonable time.
  • Providing decisions, instructions and approvals needed to progress the project.
  • Making payments according to the agreed schedule.
  • Informing us promptly about site restrictions, safety concerns or changes that may affect the work.

Delays or additional costs arising from incomplete information, late approvals, restricted access or client-requested changes may affect the project schedule or price, subject to the agreed project terms.

09

Changes and additional work

Any request to change an approved design, material, specification, measurement, layout or scope should be communicated to us in writing wherever practicable.

We will assess the impact of a requested change on cost, materials, work already completed and project timelines. Additional work will proceed after the revised scope, charges and schedule have been communicated and approved.

Changes made after materials have been ordered, work has been completed or execution has commenced may involve additional costs or practical limitations. The applicable project agreement will determine how such changes are handled.

10

Timelines and delays

Any estimated project schedule or completion date will be communicated in the relevant project proposal or written confirmation. Timelines may depend on site readiness, approvals, material availability, supplier schedules, access and other project conditions.

We will make reasonable efforts to communicate material changes to an agreed schedule. However, a date described as an estimate should not be treated as an unconditional guarantee unless expressly agreed in writing.

Where delays arise from events outside a party's reasonable control, the parties should communicate and agree on an appropriate revised schedule, subject to the project agreement and applicable law.

11

Materials and third parties

Projects may involve products, materials, appliances, fixtures, contractors, vendors or specialist service providers. Their availability, specifications, warranties and delivery conditions may be governed by the relevant supplier or manufacturer's terms.

Where third-party products or services are included in a project, the applicable quotation or agreement should identify the relevant scope and responsibility. Manufacturer warranties, where provided, are subject to the manufacturer's own terms.

Product images, samples, renders and screen representations may differ from the final appearance due to lighting, display settings, batch variations or natural material characteristics. Final selections should be confirmed using the applicable samples and specifications wherever possible.

12

Intellectual property

Unless otherwise stated, the content displayed on this website, including text, branding, graphics, photographs, layouts and design presentations, is owned by HK Design or used with permission and is protected by applicable intellectual property laws.

You may view and use website content for personal, non-commercial reference. You must not reproduce, distribute, modify, publish or commercially exploit website content without the relevant permission or legal right.

Ownership and permitted use of project-specific drawings, concepts, renders, plans and other deliverables will be governed by the relevant proposal or written agreement. Payment for a service should not automatically be treated as a transfer of all intellectual property rights unless expressly agreed in writing.

Clients must ensure that materials, images or references they provide to us may lawfully be used for the requested project.

13

Website content and availability

We aim to keep the website useful and accessible, but we do not promise that it will always be available, uninterrupted, error-free or compatible with every device or browser.

Website descriptions, photographs, portfolio examples and other materials are provided for general information and may not represent the exact scope, specification, price or outcome of a future project.

We may update, modify, suspend or remove website content or features when reasonably necessary. Such changes do not alter a separate written project agreement unless the parties agree otherwise.

14

Warranties and limitations

To the extent permitted by applicable law, the website and its general informational content are provided on an “as available” basis. We do not make a general promise that website content will be complete, current or suitable for every individual purpose.

Nothing in these Terms excludes or limits any consumer right, statutory protection, warranty or liability that cannot lawfully be excluded or limited.

Any project-specific workmanship commitment, product warranty, service assurance or remedy must be understood from the relevant written quotation, agreement, warranty document or applicable law.

Subject to applicable law and the terms of a specific project agreement, HK Design will not be responsible for indirect or consequential loss arising solely from use of general website information. This clause does not remove liability where such exclusion is prohibited by law.

15

Cancellation and termination

If you wish to cancel or pause a project, please contact us in writing as soon as possible. The effect of cancellation may depend on the stage of work, completed services, materials ordered, third-party commitments and the payment terms agreed for that project.

Any amount payable, adjustment or refund will be assessed under the relevant written agreement and applicable law. We will communicate the applicable calculation or process where a cancellation request is received.

We may suspend or discontinue website access or a service engagement where reasonably necessary due to unlawful conduct, material breach of agreed terms, non-payment or circumstances that make continued performance impracticable, subject to applicable law and any relevant project agreement.

16

Privacy and personal information

Our handling of personal information is explained in our Privacy Policy. It describes the types of information we may collect, how we use it, how it may be shared and the choices available to you.

By using our website or contacting us, you should review the Privacy Policy alongside these Terms. If you have a privacy-related question, contact us at info@hkdesign.in.

17

Changes to these terms

We may revise these Terms from time to time to reflect changes to our website, services or applicable legal requirements. The revised version will be published on this page with an updated “Last updated” date.

Your continued use of the website after revised Terms are published will be subject to the updated Terms to the extent permitted by law. Changes to an existing project agreement will require the method of variation specified in that agreement or otherwise agreed by the parties.

18

Governing law and disputes

These Terms are intended to be interpreted in accordance with the laws of India, subject to applicable mandatory legal protections and the terms of any separate written project agreement.

If you have a concern or dispute, please contact us first so that we can attempt to resolve it through communication. Nothing in this section prevents either party from exercising rights or remedies available under applicable law before a competent authority or court.
